MSA Safety Data Privacy Notice

MSA Worldwide, LLC and its affiliated companies ("MSA", also "we", “us”) own and operate this website and its subpages and the webpages of its affiliates (hereinafter collectively referred to as "Website"). The intended use of the Website is for business-to-business purposes.

When we refer to "you" or "your," we mean the person accessing this Website or whose personal data we otherwise process within the scope of this notice (see the "purpose and scope" section below). Please note: If you provide us with personal information that is not your own, please ensure that you have shown the relevant person this notice and taken steps to ensure a legal basis is satisfied.

MSA is "The Safety Company", and safety is in our DNA. We help our customers make informed decisions and pursue a safety-first, work site. Consistent with these principles, safeguarding your privacy is very important to us. We take the protection and safety of your personal information seriously and are committed to maintaining its confidentiality, availability and integrity in our business process. We strive to ensure that personal information collected by us is processed by us strictly in accordance with applicable law.

PURPOSE AND SCOPE

This MSA Data Privacy Notice ("Privacy Notice") provides transparency about personal information that MSA may process. The purpose of this Privacy Notice is to describe how MSA processes your personal information collected from and about you as a controller in the following scenarios:

  • where we deal with you in your capacity as a business contact of one of our business customers or suppliers, for example to procure, market, and/or sell products or services, to communicate with us, to perform a contract, or otherwise;
  • in some limited scenarios, where we process your personal data as a controller rather than a processor in connection with our Safety io software-as-a-service offering (see the “SAFETY IO SOFTWARE-AS-A-SERVICE OFFERING“ section);
  • processing of your personal information in connection with the provision of the Website; and

This privacy notice also describes your data protection rights, including the right to object to some of the processing which we carry out. More information about your rights, and how to exercise them, can be found in the “EU+ DATA SUBJECT RIGHTS” or the “RIGHTS FOR CALIFORNIA CONSUMERS“ section(s) insofar as they apply to you.

What is not in scope?

This Privacy Notice is not intended for MSA associates. This Privacy Notice is not intended to apply to our MSA Career Portal of the Website. Instead our Global Employee Privacy Notice will apply, which is available on our Career Portal site

SAFETY IO SOFTWARE-AS-A-SERVICE OFFERING

MSA has a part of its business, known as Safety io, which provides software-as-a-service to business customers, and such applications may collect personal information as part of those activities with MSA primarily acting as a data processor. For more information about MSA’s processing as a data processor in connection with our Safety io services, please visit the Grid and FireGrid Data Transparency Statement.

In some limited scenarios, MSA acts as a controller in connection with its Safety io services. This limited controller activity is described as part of this notice.

WEBSITE CONTROLLER

MSA Worldwide, LLC is headquartered at 1000 Cranberry Woods Drive, Cranberry Township, Pennsylvania 16066, United States, and along with its relevant affiliate companies is the controller of the data processing described in this Privacy Notice. CATEGORIES OF PERSONAL INFORMATION

For the avoidance of doubt, except where specifically stated otherwise, this Privacy Notice defines "personal information" generally as any information relating to an identified or identifiable individual, and where applicable under local data protection laws, juristic entity.

Personal information that MSA may collect and process includes the following:

  • Contact information to help us communicate with you such as to verify your account with us and to conduct marketing and online advertising activities, market research and surveys. This includes name, address, telephone number, title, username, employer, e-mail and password.
  • Online identifiers (and associated device information) to help us provide our services and keep the site secure, to optimise and improve your browser experience, and for analytics and marketing-related purposes. This includes IP address, MAC address, user settings, location selection, etc. (for a full list of associated device information, see below at “COOKIES & TRACKING TECHNOLOGIES”).
  • Relationship or transactional information to help us understand our history, who you are, your relationship to MSA or our channel partners, and what MSA products or services might benefit you. This includes user preferences and settings, transaction history, purchasing information, inquiries, customer accounts, contact and demographic information.
  • Payment or financial information to pay for our products or services. One is example is your credit card number (although as a business-to-business company, we expect that credit cards used for purchasing are tied to an entity’s business account: in this case, they would not be personal information).
  • Personal information incidental to the functioning of our products to perform analytics for safety and product improvement for the benefit of us and our business customers using our Safety io platform. For example, personal information that is generated by, collected by, or stored in MSA equipment or any hardware or device interfacing with such equipment in our Safety io platform. Examples could include geolocation data, user settings or preferences, and breathing rates in SCBA apparatus. MSA device usage information will be aggregated into statistics when it is used for these purposes.   • Product experience information that you might give in response to the market research and surveys we conduct.

Sometimes, we receive information about you from third parties. In particular:

  • We may process your contact information and online identifiers where it has been obtained by third party social media or lead generation providers in order to conduct direct marketing and online advertising activities. We will only conduct these activities where the personal information has been obtained in accordance with applicable law and where we have a lawful basis to do so.
  • We may obtain your contact information from your employer where we are dealing with you as a business contact in connection with the provision of our products or services to our customers.

LEGAL BASIS AND PURPOSE OF PROCESSING

MSA processes personal information in accordance with applicable law. Reasons that MSA might process your personal information, and (where required under applicable law) our "legal basis" for processing this information, include:

  • To provide you or your customer a product or service (contractual necessity where the contract is directly with you, or otherwise our legitimate interest in performing our contractual obligations towards our business customers) we use contact information, relationship or transactional information and payment or financial information.
  • To enable communications and interactions between MSA and you which are necessary to provide our services (e.g., product support) (contractual necessity where the contract is directly with you, or otherwise our legitimate interest in performing our contractual obligations towards our business customers) we use contact information and relationship or transactional information.
  • To send you tailored marketing and social media/online advertising about MSA products and services, including through promotions or surveys (our legitimate interest in commercialising our products, or (if applicable) your consent where you sign up to receive marketing communications from us or consent to online targeting) we use contact information, relationship or transactional information, and online identifiers. We may apply "list-based" targeting to support MSA marketing efforts, where we may confidentially provide first-party data such as name and email to our advertising partners for MSA marketing purposes only.   • For business analytics purposes, such as researching or evaluating our products or services and to make enhancements for the benefit of us and our business customers; and to optimise and improve the performance of the Website (our legitimate interest in improving our products and services, or (if applicable) your consent to analytics via cookies) we use online identifiers, contact information (names), personal information incidental to the functioning of our products, and product experience information. MSA device usage information will be aggregated into statistics when it is used for these purposes.   • For legal, safety or security reasons, such as to protect ourselves against liabilities, or to protect our associates, customers, intellectual property, etc. (our legitimate interest in protecting our business interests and legal rights) we use all categories of personal information listed above.
  • To enforce our policies (our legitimate interest in protecting our business interests and legal rights) we use all categories of personal information listed above.
  • To comply with legal or regulatory requirements (Compliance with legal obligation bases) we use all categories of personal information listed above.
  • For any other purpose that is related to the foregoing, compatible with applicable law, and/or for which you provide consent (Various bases) we may use all categories of personal information listed above.
"STAY INFORMED"

You have the option to receive company news, industry resources and product information from us via e-mail by signing up through our "Stay informed" feature. We will not use or sell your e-mail address for any other purpose except as authorised by you or where we have a legal basis to do so

NEWSLETTERS

We also offer you the opportunity to subscribe to newsletters through this Website or other marketing tools. Data provided during newsletter registration will be used only for the purposes of sending out the newsletter unless you have provided consent for other uses, such as receiving other advertising or information related to MSA. You can cancel the newsletter subscription at any time by using the unsubscribe option provided in the newsletter.

Where consistent with the purposes described above, MSA may share your information with persons and entities other than the MSA entity that originally collected it. For example, MSA may share your personal information with:

  • our affiliates who are involved with the provision or management of our services,
  • third-party service providers, for example providers for hosting and maintenance, customer service operations, identity checking, sending postal mail and email, processing payments, legal advice, and for digital advertising, including, for example, on social media,
  • business partners like authorised distributors,
  • recipients of, or bidders for our company or business (and their professional advisors) in a merger or acquisition scenario, and
  • others for legal, safety, or security purposes (e.g., regulators or law enforcement). to protect our rights; with your consent; to fulfil our business purposes; or to enforce or apply our agreements, policies, or terms of use.

In each case, we seek to avoid sharing more personal information than is necessary to fulfil the purpose of sharing and in accordance with applicable law. We may also anonymise or aggregate personal information to share with third parties.

Some of the above third parties may be located in overseas jurisdictions from where you are located (for example, our Website and Career Portal are hosted in the US). We will only make these transfers where, if required by applicable law, we have an appropriate transfer mechanism in place. DATA SECURITY AND RETENTION

MSA takes data security seriously. We use administrative, technical and organisational security measures designed to protect the data supplied by you and managed by us with the aim of ensuring its confidentiality, availability and integrity. We have taken security measures to protect against the manipulation, loss, destruction, and access of personal data by third parties, and our website security is continually being improved with developing technology.

Although we take the measures described above to ensure the confidentiality of your data, MSA – like any company doing business online – cannot absolutely guarantee its security. You should be aware that there is always some risk in transmitting information over the internet, and when you use our Website, you do so at your own risk.

We erase or anonymise your personal information when it is no longer required for the purposes for which it was collected. For example (and subject to any legal obligation to further retain such data):

  • If we collect your IP address or other user device information, we only store it on our web server for the period necessary to help us provide our services and keep the site secure, and to conduct relevant analytics and advertising-related activities.

ShopMSA offers authorized MSA Channel Partners the ability to check product pricing and availability, create and review orders, view account details, and similar uses. If you use shopMSA, it may collect personal information incidental these activities, such as channel partner account manager name, business e-mail addresses, and payment information. MSA will process this information consistent with the legal basis for the processing described above.

EU/UK/SWITZERLAND (COLLECTIVELY, “EU+”) DATA PRIVACY STATEMENT

This EU+ Data Privacy Statement provides certain supplementary transparency information about any "personal data" of EU+ data subjects per EU+ legal requirements (including Art. 13 of the EU General Data Protection Regulation (GDPR), as well as local law based on the EU ePrivacy Directive).

INTERNATIONAL TRANSFERS OUSIDE THE EEA/UK/SWITZERLAND

MSA’s Corporate Headquarters are in Cranberry Township, Pennsylvania, USA. Accordingly, this Website is hosted in the United States. If you are visiting this Website from outside of the United States, your information is being transferred to, stored or processed in the United States in addition to our shared service centres within the EEA.

We may also use other service providers located outside the EEA/UK/Switzerland, for example in the United States.

In some scenarios where your personal information is transferred to the United States, where the party receiving the data has certified under the EU-US Data Privacy Framework, the UK Extension to this Framework, and the Swiss-US Data Privacy Framework (together, the “DPF”), the transfer is made on the basis of the adequacy decision or regulation of the EU Commission or UK/Swiss government in respect of the United States.

In the majority of cases, where the transfer destination is not covered by an EU Commission or UK/Swiss Government adequacy decision or equivalent (including transfers to the United States where the recipient is not certified under the DPF), we will rely on data transfer mechanisms (e.g. the EU’s Standard Contractual Clauses (EU SCCs), UK International Data Transfer Agreement (IDTA) and/or the UK addendum to the EU SCCs), and applicable amendments to those mechanisms in accordance with Swiss law. EU+ DATA SUBJECT RIGHTS

If you reside in an EU+ area, you have the following rights:

  • The right to be informed about our collection and use of personal data (see this Privacy Statement sections above);
  • The right of access to the personal data that we hold about you;
  • The right to rectification if any personal data We hold about you is inaccurate or incomplete;
  • The right to be forgotten – i.e., the right to ask us to delete any personal data that we hold about you (although MSA only holds your personal data collected through this Website for limited time periods);
  • The right to restrict (i.e., prevent) the processing of your personal data;
  • The right to data portability (obtaining a copy of your personal data to re-use with another service or organization);
  • The right to object to us using your personal data for particular purposes; and
  • Rights with respect to automated decision making and profiling.

These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required to retain in order to exercise or defend legal claims.

RIGHTS FOR CALIFORNIA CONSUMERS

In addition to any rights provided under the Privacy Notice above, California law provides additional rights for California consumers. Here is a description of some of the rights that a California consumer may have, depending on their relationship with MSA:

  • The right to request a description of the categories and specific pieces of "personal information" that we have collected about them.
  • The right to know the categories of "personal information" about them that we may disclose to third parties for a business purpose, with a description of categories of third parties that may receive such information.
  • The right to request that we delete "personal information" about them that we have collected from them.

1MSA does not sell your data – we are not data brokers, and we don’t put your data on the open market. However, under California’s privacy law, sharing of personal information (e.g., to provide you with personalized ads) may be considered a “sale,” even if no money is exchanged. If you opt out, MSA will stop sharing your information, including with some of our advertising partners, and you will no longer receive personalized offers from MSA on some sites or services.
